Privacy Policy for Marco: A Travel Companion

Marco (“the App”, “we”, “our”, “us”) is committed to respecting your privacy and ensuring compliance with the European General Data Protection Regulation 2016/679 (“GDPR”). This Privacy Policy explains what personal data we collect, how we use it, and how we protect it. By using the App, you consent to the processing of your data as outlined in this Privacy Policy.

1. Information We Collect

a. Account Information:

  1. When you sign up with Google, we receive your email address, name, profile picture, and language preferences, but we do not use or store your profile picture.
  2. When you sign up with Apple, we receive your email address (or a relay email if you choose to hide it), and your name.

b. Conversations with the LLM-guide: We store the conversations you have with the LLM-guide to enhance the App’s functionality, ensure quality, and improve future interactions. These conversations are linked to your account but are not shared externally.

c. Usage Data: We collect anonymized data about your interactions with the App to help monitor and improve its performance. This data is not linked to your personal information.

d. Communications Data: If you contact us for support, we collect data you provide via email (marcotravelcompanion@gmail.com) to resolve your inquiry.

2. How We Use Your Data

a. We use your data for the following purposes:

  1. To provide and deliver App features, such as unlocking paid content.
  2. To improve the App’s functionality and your experience based on your feedback and usage patterns.
  3. To provide location-specific content.
  4. To respond to inquiries, send notifications, and update you about features.
  5. To monitor and protect the App’s security, including fraud prevention.

3. Data Sharing

We do not share your personal data with third parties unless required by law, for fraud prevention, or to protect our legal rights.

4. Retention of Personal Information

a. Data Retention Period: Personal data is retained only as long as necessary to fulfill the purposes outlined in this Privacy Policy or comply with legal obligations.

b. Deletion: You may request deletion of your data by contacting marcotravelcompanion@gmail.com. We will securely delete your data within 30 days, provided no legal need exists to retain it.

The App integrates with Apple Maps and Google Maps for navigation. Please note that these services are not covered by this Privacy Policy, and we recommend reviewing their privacy policies before use.

6. Your Rights

a. Under GDPR, you have the right to:

  1. Access: Know what personal information we process.
  2. Rectification: Request correction of inaccuracies.
  3. Deletion: Request deletion of your personal data, subject to legal requirements.

a. Location Data: Required for map functionality. This data is not stored. You can disable location access in your device settings.

b. Microphone Access: Required for Speech-to-Text feature. You can disable this permission in your device settings.

c. Camera Access: Required for you to add photos to the chat interface. You can disable this permission in your device settings.

d. Account creation: You can use the free version of the App without signing up. Access to locations beyond free trial requires Google or Apple sign-in and purchase of a pass.

8. Data Security

We implement robust technical and organizational measures to safeguard your personal information against unauthorized access, loss, misuse, or alteration. While we strive to maintain the highest standards of security, no system is entirely foolproof. In the unlikely event of a security breach, we will act promptly to address the issue and minimize any potential impact.

9. Changes to This Privacy Policy

We may update this Privacy Policy periodically. Significant changes will be notified in the App, with the “Effective Date” updated at the top of this document.

10. Final Provisions

a. Severability: If any part of this Privacy Policy is found invalid, the remaining provisions remain unaffected.

b. Governing Law: This Privacy Policy is governed by Portuguese law. In the event of a dispute, we encourage you to seek resolution through our customer service via our email marcotravelcompanion@gmail.com before initiating any legal proceedings. If the dispute cannot be resolved amicably, you shall address the exclusive jurisdiction of the courts in Portugal.
